The Supply Chain Due Diligence Act and its consequences: Can't see the wood for the trees?
The Supply Chain Duty of Care Act is turning the European economy on its head. It requires medium-sized and large companies to implement a multi-layered risk management system that goes far beyond their own area of responsibility.
Do you have 1,000 employees or more? Then you have been obliged to prevent violations of human rights and environmental protection regulations within your supply chains since January 1, 2024.
In plain language: if one of your suppliers on the other side of the world dumps waste into the sea or endangers the health of its employees, you could be prosecuted.
What is of course of great importance from an ethical point of view, entails a whole slew of tasks for you as the person responsible for risk management:
- Preparation of a policy statement on the human rights strategy signed by the management (Section 6 (2) Lksg)
- Carry out a risk analysis of all suppliers and customers and appoint a responsible person to identify, minimize and avoid risks to people and the environment (§ 5 Lksg)
- Developing suitable prevention measures (§ 6 para. 1, 3, 4 Lksg)
- Development of an effective complaints procedure to be applied in the event of detected violations (Section 8 Lksg)
- Regular monitoring of all measures
- Initiation of remedial measures in the event of identified legal violations (Section 7 Lksg)
- Regular documentation and reporting on the fulfillment of due diligence obligations (§ 10 Lksg)
Because if one of your suppliers violates a regulation, this can mean a temporary interruption to your supply chain or, in the worst case, the end of the collaboration. You therefore need even more alternatives in your supplier portfolio to ensure the competitiveness of your own company at all times. Incidentally, the regulations are also to be extended to all SMEs with up to 250 employees by the end of 2025 at the latest.
This means that even if you are not currently affected, it is only a matter of time before the LkSG catches up with you - which is why you already have to deal with many new questions, such as:
- What are the risks of human rights violations and environmental damage in my supply chains?
- What actions by my suppliers and customers could get my company into trouble?
- Do I have enough knowledge of the processes within my supply chains to understand potential risks?
- What can I do to proactively identify risks?
- What measures do we take within the company to prevent human rights violations and environmental damage?
- How do I document our efforts to comply with the LkSG?
- Which of the many pieces of information are important and which are not?
- How do I protect my company from the consequences of violations by our business partners?
You have probably already realized that such a complex subject area as LkSG, with all the pitfalls and challenges mentioned, is difficult to handle with Excel and the like...

LkSG FAQs - the most important questions about the LkSG legal text and our LkSG software
The Supply Chain Due Diligence Act (abbreviation LkSG) is a German law that has been in force since January 2023. It obliges large companies to manage human rights and environmental risks along their supply chain.
The LkSG was tightened again at the beginning of 2024 and the scope of application expanded. Since January 1, 2024, companies with more than 1,000 employees (previously 3,000 employees) must ensure that fair working conditions and environmental standards are observed throughout their entire supply chain.
Violations can lead to legal consequences, with the law also affecting foreign companies that do business with German companies. Further information on the LkSG can be found on the official website of the BAFA (Federal Office of Economics and Export Control).
With antares RiMIS®, you get an intelligent LkSG tool that is customized to your individual needs and guarantees legal compliance, efficient risk management and simple, transparent documentation.
Time savings, clear workflows and reliable protection against penalties make our tool the ideal solution for your entire supply chain management. We also offer you comprehensive LkSG training on the software, including advice on LkSG implementation in your company.
The Supply Chain Due Diligence Act (Lieferkettensorgfaltspflichtengesetz - LkSG) requires companies to provide transparent reporting on their human rights and environmental compliance measures in their supply chains.
Companies must disclose their efforts and results in relation to LkSG compliance to ensure that they meet the legal requirements.
The cost of antares' LkSG software depends on the specific requirements and needs of your company.
